Goldendraw Limited – STANDARD COMPETITION TERMS
Qualifying Persons:
Our Competitions – the competitions are open to all persons aged 18 and over. Employees of the promoter or family are restricted from participating in the competition.
We reserve the right to remove any member if we feel that they are being abusive to any of the staff or any other entrant, be it on the Website or any Social media link.
Legal Undertaking:
By entering a Competition the Entrant will be deemed to have read and understood these rules and to be bound by them and by any other requirements set out in any related promotional material. It will also be deemed that they have the correct legal age and capacity to do so.
Competitions are governed by English Gaming Laws. In the event of playing a Competition online, by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions.
The Promoter will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the website and check with the relevant authorities in your country.
Competition Entry:
Competitions may only be entered, online, or with a member of our specialised sales team. Availability and pricing of Competitions is at the discretion of the Promoter:
When playing a Competition online follow the on-screen instructions and play the Competition as outlined in the directions. When you are ready to purchase your Ticket(s), follow the on-screen instructions to provide your contact details and your credit card details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition rules. When your credit card payment has cleared we will then contact you by email to confirm your entry into the Competition. Please note that when entering online you will not be deemed entered into the Competition until we confirm your Ticket order back to you by email.
In order to enter a competition, you will need to register an account with us online and provide all the details in the boxes provided in the members sign up page. If you wish to enter any of our competitions for free then you must send an unenclosed postcard via First Class post stating: Which competition you would like to take part in along with your personal details as follows; Competition prize entered, Full Name, Date of Birth, Postal Address, Email address, One contact number. All entrants including those that enter for free must create an account online prior to entering any competition, registering the same details as normal to register an account.
All our ticket Limited Competitions:
Ticket Limited Competitions will close when ticket sales have reached the number specified. On all competitions the number of entries will be highlighted, i.e. the exact number of tickets available. The Winner will be the lucky person whose ticket number is drawn out either by the promoter or by a computerised random number generator, the whole process being overseen by independent lawyers.
The Promoter reserves the right to cancel any Limited prize draw Competition, for any reason, In these circumstances the Promoter reserves the right to transfer the Entrants’ Ticket(s) into another Competition for which the ticket price is at least the same or more than the original price paid.
Ticket Limited Competitions:
Ticket Limited Competitions will close when the specified number of Tickets has been sold. The Promoter reserves the right to close any Ticket Limited Competition prior to all of the tickets being sold. In this situation the Promoter at its sole discretion will either award the full prize in the normal way, or, calculate the total number of tickets sold as a percentage of the total number specified for that Competition, with the prize forming the same percentage of the cash alternative. By way of example if only 67/100 or 67% of the tickets had been sold when the Competition closed and the cash alternative for the Competition prize was £1000, the new prize would become £670 and the judging would continue as normal.
The Promoter will attempt to contact Competition Winners using the telephone numbers and email address provided at the time of purchase (or as subsequently updated) and held securely in our database. If for any reason we are unable to contact a Competition Winner within 90 days of the end of a Competition, the Competition Winner will forfeit the prize and it will be awarded to the reserve Entrant, as defined in the judging process. For the avoidance of doubt once the prize has been forfeited the original Competition Winner will have no further claims against the Promoter. The entrant must ensure all details are correct at time of entry, and also notify the promoter if there are any changes.
All Competition Entrants are automatically entered onto the Promoter’s database for the purpose of conveying information as to the status of their Competition, as well as for any future promotions or Competitions offered by the Promoter.
Winner’s Details:
The Winner will be required to send a photocopy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered. The Winner will also be required to provide photographs for use in future marketing by the Promoter. Following receipt and verification of the details requested above by the Promoter, the Winner will be contacted in order to make arrangements for delivery of the prize Competition.
Prizes:
Prizes that are offered by the Promoter may be used as marketing prior to the competition closed date.
If the Winner would like to take a prize that the Promoter does not already own, an order will be placed by the Promoter. Please note that if the Winner decides to do this, delivery may take up to three months or the winner contacted and offered an alternative prize of a similar value. All vehicles will be suitable for the country of origin of the winner. For example cars will either be in left hand or right-hand drive, electrical items will be supplied suitable for the competition winner’s home country, (subject to manufacturer availability and terms and conditions).
In the UK the prize will be delivered with UK VAT paid. In the EU the prize will be delivered with UK VAT paid but any further costs (VAT/taxes/import duties/registration costs due in the destination/country of final registration) will be the responsibility of the prize Winner.
In all other countries the prize will be shipped (net of all taxes) to the nearest port and any applicable import duties/taxes/registration costs due in the destination country will be the responsibility of the prize Winner. The promoter reserves the right not to deliver to certain countries. Please note that all our cars are supplied in the UK and therefore if exported may not be road legal in the destination country. It is the winner’s responsibility to check this and choose an alternative car or take the cash alternative if appropriate.
Shipping costs will be the responsibility of the competition prize draw winner who will be advised by the promoter. The competition winner also can organise their own shipping if the supplied quotation is not acceptable from the promoter. There is a maximum 30 day period after notification for the competition winner to arrange their own shipping.
Storage:
The Promoter will store the chosen prize free of charge for 30 days after notifying the Winner, at the end of which time the prize will be delivered to the Winner.
Winners’ Personal Data:
Acceptance of the prize by the Winner gives the Promoter the right to use the prize-Winner’s name, personal photograph and home country for promotional purposes, both immediately after their win and in the future, unless prohibited by law.
Limits of Liability:
The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner and, where applicable, to any family/persons accompanying the Winner, or in connection with any of the Competitions promoted by the Promoter.
Electronic Communications:
No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.
Data Protection Notice:
Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition; and unless you tell us that you prefer not to receive direct marketing to contact you about other Competitions or about other goods and services which the Promoter considers may be of interest to you.
In order to process, record and use your personal data the Promoter may disclose it to any credit card company whose name you give; any organisation (whether or not connected to the Promoter) for the purpose of bringing to your attention goods and services which the Promoter considers may be of interest to you; any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you; any person to whom the Promoter proposes to transfer its business or any part of it; comply with any legal or regulatory requirement of the Promoter in any country; and prevent, detect or prosecute fraud and other crime.
In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
